TERMS AND CONDITIONS

 

 

PLACING ORDERS

The Seller is Flemming Cafe Mateusz Szymański company with its registered office at Jana Dantyszka 10, 80-204 Gdańsk. NIP (Tax Identification Number:) PL 957-100-27-12.

 

Reading the terms and conditions is obligatory before placing an order. The Purchaser explicitly states that he/she understands and accepts those terms and conditions.

Purchase is made by placing an online order. Orders are accepted 24hours/7 days a week via www.flemming-cafe.pl website.

Service is intended only for persons aged 18 or over. The Purchaser at the moment of placing an order confirms that he/she is 18 or over.

 

 

ORDER COMPLETION AND DELIVERY

Processing of the order is started when the Purchaser confirms all data required for order completion. The Seller reserves the right to cancel the order if it does not contain all the required data or if the Seller is not able to complete a given order. Orders are sent out within 2 business days from the date of crediting the Seller's account. The time of order completion may be longer if the Purchaser does not indicate the number of the order in the transfer title. The order is sent via a courier service or collected in the shop. In case of collecting the order directly in the shop the Seller will notify the Purchaser about the completion of order and the Purchaser will collect the order within 7 calendar days from the notification. The time of delivery by a courier service depends on the courier service company and is subject to the regulations of that company. In most cases the delivery is made on the next working day after its dispatch. Courier service companies do not deliver parcels at the postbox addresses. Courier makes two attempts at delivering the parcel. Orders made at the company addresses may be delivered to the reception or secretary's office, they are not handed in to a specific person. The information about the order and its status is available on the website under "My account" and via e-mail.

Each order includes purchase document in the form of a receipt or a VAT invoice.

Comments made by the Purchaser in the "Comments" box are taken into account and, if possible, realised by the Seller. They cannot be treated as benefits guaranteed by the Seller.

Ground coffee picked-up in our retail store with the option "Payment at pick-up" will only be ground after making payment, in this way the product will be of guaranteed freshness.

 We do not deliver coffee to Germany due to customs restrictions.

 

SHIPMENT AND RETURNS

Orders are sent by DPD - courier services company.

 

Cost of shipment (incl. VAT):

On the territory of Poland:

  • 18 PLN for the shipment of up to 30 kg
  • 5 PLN of cash on delivery fee

Estimated delivery date:

On the territory of Poland it is usually the next working day after dispatch.

On the territory of EU it is usually 2 - 5 working days after dispatch.

The above are merely estimated times and we cannot be held responsible for any delays.

 
 
Returns:

In accordance to the Act of December 25th 2014 concerning protection of certain consumer rights and liability for damage caused by a hazardous product, Buyer may return the purchased product within 14 days from the date of collecting shipment without stating a reason. The returned product mustn't be used or damaged, its packaging mustn't be opened. Ground coffee cannot be returned since each time the coffee is ground upon individual Customer's request.

Vendor has the right to reject the returned product if it bears any traces of use or if it is damaged. This right applies also in case of a damaged parcel delivered to Vendor.

Customer informs in writing (e-mail with confirmation of being read, registered letter with acknowledgement of receipt- address below) about the withdrawal from the contract of purchase (translated into Polish). The cost of shipment is paid by the Customer, we do not collect parcels to be paid for by recipient. Parcel with the product must contain original proof of purchase (receipt/invoice).

Refund is made within 14 days onto a bank account defined by the Customer.

PAYMENT TERMS

Prices are given in Polish Zloty and include VAT. Product prices are subject to change. Product catalogue may change: existing products may be modified, deleted and new products may be added. The Seller may introduce and end promotional offers as well as make alterations in those offers.

Buyer may choose one of the following payment methods:

  • cash on delivery: the amount due is collected by the courier at the time of delivery (fee: 5 PLN)
  • cash or debit/credit card at pick-up in the shop
  • bank transfer to Flemming Cafe Mateusz Szymański, Jana Dantyszka 10, 80-204 Gdańsk, bank account in AliorBank: 95 2490 0005 0000 4530 2518 1900
  • electronic payments (transfers, instalments, debit/credit cards): using przelewy24.pl (operated by PayPro SA Agent Rozliczeniowy, ul. Pastelowa 8, 60-198 Poznań, entered       in the Company Register of the National Court Register kept by the District Court in Poznań Nowe Miasto and Wilda in Poznań , VIII Commercial Division of the National Court Registerąd under the number KRS 0000347935, NIP (Tax Identification Number) 7792369887, Regon (the National Official Register of the Economy Units) 301345068). PRIVACY POLICY AND "COOKIES"

 

In accordance to the Act of 29 August 1997 on the protection of personal data we inform that personal details of our Customers are stored only for the purposes of order completion with data protection requirements specified in the Act on personal data protection. Access to data, their alteration and deleting is possible via user panel available at www.flemming-cafe.pl/en/moje-konto (for logged-in users).

We undertake no liability for damages occurring as a consequence of Customer giving to third parties access to his passwords, access to e-mail accounts, login details, links for tracking orders or other non-public data provided for order fulfilment or as a consequence of a third party gaining access to this data illegally (identity theft, hacking attacks, breaking into e-mail account). User's password is stored in the system in an encrypted form and no person has access thereto.

By placing an order in www.flemming-cafe.pl shop the customer agrees to his/her personal data being used and processed for the order completion by Flemming Cafe in accordance to the Act of 29th August 1997 on the protection of personal data - Dz. U. issue 133 item 883. as amended.

By accepting the terms and conditions of service the Customer declares that he/she is aware of the fact that they have the right to access, change and delete their personal data. Request for deletion of personal data may be sent by e-mail at biuro@f-cafe.pl.

 

Cookie files

Cookies are small text files stored on your website by our service and read by our service. Those files do not store personal or sensitive data, they are used for securing the proper functioning of our site and gathering statistical data. We do not gather data that are used for marketing purposes of third parties nor do we share gathered statistical data with anyone.

 

What do we use cookies for

We use various cookie files which are needed for:
